Terms of Service
Draft v0.1 · 22 October 2026
These terms govern the use of the BIG Prop Co. platform by residence operators (“Customers”) and by the residents and staff they invite (“Users”). [attorney: consider separate Customer subscription agreement vs User terms; Consumer Protection Act and ECTA applicability]
1. Accounts
- Accounts are invite-only. Keep your password confidential; you are responsible for activity on your account.
- Operators decide which roles their staff and residents have and must remove access when someone leaves.
- You must give accurate information. Do not sign in as someone else.
2. Acceptable use
- Use conduct reports in good faith. False or malicious reports may lead to disciplinary action under your residence rules.
- Do not upload unlawful content or other people’s personal information that isn’t needed.
- Do not try to access another organisation’s data, reverse-engineer the platform or get around rate limits or security controls.
3. Subscriptions (Customers)
Plans, prices (ZAR, [VAT inclusive/exclusive]), the 30-day trial, billing through Paystack, cancellation and refunds: [complete]. If an account is overdue, we may restrict it after [notice period].
4. Rent, leases and payments
The platform records rent and generates invoices, receipts and e-signed leases on the operator’s behalf. The lease is between the operator and the resident; BIG Prop Co. is not a party to it unless BIG Prop Co. is the operator [confirm; Rental Housing Act compliance remains the operator’s responsibility]. Electronic signatures are made under the Electronic Communications and Transactions Act 25 of 2002.
5. Help assistant and document reading
The help assistant and automated document reading (OCR) can make mistakes. Payments read from NSFAS statements or receipts are only posted after a person confirms them. Assistant answers are not legal, financial or emergency advice. In an emergency, use the emergency contacts.
6. Data protection
Our Privacy Policy describes how we process personal information. For Customers, our operator agreement under POPIA s21 forms part of these terms [attach].
7. Availability and liability
We aim for high availability but don’t guarantee uninterrupted service. To the extent the law allows, our liability is limited to [fees paid in the previous 12 months]. [attorney: CPA s48–49 limits for consumer Users]
8. Ending use
Customers may export their data from the Export centre before their account closes. We delete or return Customer data within [period] of termination, unless the law requires us to keep it.
9. General
South African law applies. Courts: [jurisdiction]. Contact: info@bigpropco.com · [physical address for service of legal documents].
